Terms of Use
These terms govern your use of the SabioTrade website and the services connected to it. By creating an account you accept them, so it is worth ten minutes of reading now rather than ten minutes of surprise later.
1. Use of the website and services
This website is an informational and marketing platform operated under the trading name SabioTrade. Through it we present tools, analysis and account services related to trading in financial assets. Where execution of trades, custody of funds or other regulated activities are involved, they are carried out with the relevant licensed entity or provider, and the particulars of that relationship are confirmed to you during onboarding.
You may use the website and the services for their intended purpose: learning about the platform, registering an account, operating that account and communicating with us. You agree to use the service in a manner consistent with applicable law and these terms.
2. Limitations
The platform provides tools and information; it does not provide personal financial advice tailored to your objectives, situation or needs, and nothing on this website should be read as such advice. Decisions to trade, and the amounts you trade, remain yours. Automated strategies execute according to their configuration and current market conditions, not according to any promise of outcome.
Availability of particular features, assets, payment methods or account types may vary and can change. Where a change materially affects an existing account, we communicate it through the platform or by email before it takes effect.
The service is intended for users resident in Australia who are eighteen years of age or older. Registering an account confirms both facts. If your circumstances change so that either stops being true, tell us: continuing to operate an account you are not eligible for creates problems that are easier to fix early.
3. Marketing materials and information emails
From time to time we send service messages (account security, verification, withdrawals) and, with your consent, marketing messages such as market summaries, platform updates and educational articles. Service messages are part of operating your account and cannot be switched off entirely; marketing messages can be unsubscribed from at any time using the link in each message or a request to support.
Marketing content is informational. It may describe how features work or what markets have done, but it does not tell you what to trade, and it is not an inducement to trade any particular asset.
4. Intellectual property
The website, its design, text, graphics, logos, the SabioTrade name and its marks are owned by us or licensed to us and are protected by intellectual property law. You may view, download and print material for your own personal, non-commercial use connected to the service, provided the material stays unaltered and keeps any attribution.
You may not republish, resell, sub-license, scrape at scale or systematically extract the content, or use it to build a competing dataset or service, without our prior written permission.
5. Confidentiality
Each party may come to hold information of the other that is not public: for you, aspects of how our systems operate that are disclosed in support conversations; for us, your account details, trading activity and documents. Such information is kept confidential and used only for purposes connected with the service, subject to disclosure required by law or by a regulator.
Your obligations around confidentiality do not restrict information you developed independently, information that is or becomes public through no fault of yours, or information you must disclose under a legal obligation.
6. Links to other websites
The website may reference third-party websites, including payment providers and exchanges, for your convenience. Those sites are operated by others, under their own terms and policies. A link is not an endorsement, and we are not responsible for the content, availability or practices of linked sites.
When you leave our website, check where you are. In a financial context, look-alike domains are a common attack; our Fraud warning page explains how to verify you are on a genuine SabioTrade page before entering credentials.
7. Prohibited use
You may not use the website or service to break any law or regulation; to transmit spam, malware or deliberately excessive requests; to attempt unauthorised access to accounts, systems or data; to probe or breach infrastructure security; or to infringe the intellectual property rights of us or any third party. You may not open an account for someone else's benefit while hiding that arrangement, or misrepresent your identity in verification.
We may suspend or terminate access where we reasonably believe prohibited use has occurred, and we cooperate with authorities where obligations require it. Where the underlying law of Australia applies to a prohibited-use matter, that law governs the consequences.
8. Support
Support is available by email at [email protected] during support hours (Monday to Friday, 8:00 am to 6:00 pm AEST), covering account questions, platform features, deposits and withdrawals, and escalation of problems. Response times vary with volume, and enquiries that require compliance review can take longer than routine ones.
If a support interaction leaves a problem unresolved, the Complaints page sets out a formal path with defined timelines, independent of the person you first dealt with.
9. Warranty disclaimer
The website and services are provided on an "as available" basis. Except to the extent that law implies warranties that cannot be excluded, we disclaim warranties of every kind regarding operation, availability, accuracy or fitness for a particular purpose. Information on the website, including market-related content, is believed reliable when published but is not warranted as complete, timely or error-free.
Markets change, data feeds hiccup and software has defects. We work to fix what breaks, quickly and transparently, but we do not promise an uninterrupted or defect-free service, and nothing in these terms should be read as such a promise.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising from or connected to the website or the services is limited to the amount of fees you paid to us in the three months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, including lost profits, lost savings or trading losses resulting from market movements, service interruptions or data delays.
Trading losses that flow from the ordinary risks of markets are yours; the Risk disclosure describes those risks in detail. Nothing in these terms excludes liability that cannot lawfully be excluded, including guarantees conferred by Australian consumer law where they apply.
Where several people share an account login, the person who registered it is responsible for everything done through it under these terms, which is one practical reason we prohibit sharing credentials at all.
11. Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your violation of applicable law, or your misuse of the website or service, provided we notify you of the claim promptly and reasonably cooperate in its defence.
This indemnity does not apply to the extent a claim arises from our own breach of these terms or from our negligence, and it operates alongside, not instead of, the liabilities allocated elsewhere in these terms.
Other provisions
These terms are governed by the laws applicable in Australia, and the courts of that jurisdiction handle disputes, without affecting rights you may have to external dispute resolution via AFCA as a consumer. If any clause is found unenforceable, the remainder stays in force, and the unenforceable clause is read as narrowly limited as needed to make it enforceable.
We may update these terms as the service evolves. The current version is always the one published on this page, and it takes effect when published. For material changes affecting existing accounts we notify registered users in advance by email or in-platform message. Continued use of the service after a change takes effect is acceptance of it, and you are encouraged to revisit this page from time to time. Questions about these terms go to [email protected].
